The Model Book (TMB) sets out to be the world's most comprehensive photographic Modeling industry tool. It aims to be an indispensable network and reference to empower users by providing information so that its members can work safely and professionally and in-turn help to improve the overall creative output within the industry.
The Model Book (TMB) aims to present and run its self as a forward thinking and practicing organization. Placing its service to members first. Developing features and services to benefit all members with decisions and actions being implemented to suit the majority, on every aspect of the sites development. The phrase run by its members for its members is an ideal that The Model Book (TMB) ultimately aims to realize.
The Model Book (TMB) offers a FREE or subscribed enhanced services community for: Models, Photographers, Stylists, Makeup Artists, Hair stylists, Agencies and people within the photographic modeling industry. The Model Book (TMB) gives users the ability to create individual profiles and portfolio of images and details so that members can present and promote them selves to other The Model Book (TMB) users.
The Model Book (TMB) offers user profile hosting via the TMB Website for public access. The Model Book (TMB) provides the ability for users to view other user profiles and user to user information and promotional marketing as well as communication via either one of, a combination of or all of the following ways: Email, chat rooms, Notice Boards etc.
The Model Book (TMB) does not support the exploitation of its members. It offers a free hosting and communication hub to members as well as a subscribed enhanced service to paid members. It aims to operate in the most transparent manner possible making all information regarding services and cost of services available and as obvious as possible.
All users are responsible for the content of their own individual profile. The Model Book (TMB) does not own or claim to own any Intellectual property, portfolio content or images uploaded by individual users.
It is the responsibility of the user or member to adhere to these terms and conditions.
The Model Book (TMB) uses third party payment systems\; each user is responsible to review and abide by the rules of those systems.
The Model Book (TMB) provides a Chat Room Service as well as a Forum and other methods for users to post information, comments and feedback both in real time and poster permanent or semi permanent form.
Users Agree not to post or communicate any: false, unlawful, misleading, fraudulent, slanderous, harmful, hateful, profane, obscene, threatening, racist, abusive, harassing or any objectionable material of any kind. Failure to adhere to these terms and conditions could result in the permanent removal of the offending users profile without warning or refund.
Users Agree not to post, any material that may encourage conduct that would violate the rights of others, constitute a criminal offense, or otherwise violate any applicable local, national or international law. Users agree not to post any information or correspondence that is inappropriate or not of a professional nature or which otherwise violate any applicable local, national or international law including International trademark or copyright laws and restrictions in any way. Failure to adhere to these terms and conditions could result in the permanent removal of the offending users profile without warning or refund.
The user agrees to take sole responsibility of all posts and communications made by that user on The Model Book (TMB)
Users agree not to hold The Model Book (TMB) responsible in any way for posts and communications made by that user on The Model Book (TMB) or any subsequent claims or actions arising from the posts or communications.
Content of Portfolios, profiles chat, notice board advice center or any other type of content posted by users remain the responsibility of the user. The Model Book (TMB) is under no obligation to edit, modify or censor any of the material submitted although efforts will be made to ensure that inappropriate material is removed. And the users responsible for that material will be warned or removed.
Users agree and acknowledge that The Model Book (TMB) do not control material and content posted by users but reserve the right to remove change or modify as seen appropriate any submitted material in portfolios or any other part of the site without prior notice.
The Model Book (TMB) is portfolio Hosting service. Any information posted by members including statements, advice, services, offers, opinions or any other content or information posted by members ant where on the Model Book Site or server ifs the responsibility of the author and or person or member who made the post and are liable for the content of their posts and uploads.
The Model Book (TMB) reserves the right to edit posted material and or text to keep it in the ideals and styles of The Model Book (TMB) as seen fit and by the sole discretion of The Model Book (TMB). The Model Book (TMB) also reserves the right to refuse to post or remove content that they deem to be unsuitable or inappropriate and at their sole discretion. This includes any text or copy, images, links, URLs email addresses posted anywhere within the site.
YOU EXPRESSLY AGREE THAT:
1. Use of the service and the site is at your sole risk. The Model Book (TMB) does not warrant that service or the site will be uninterrupted or error free.
2. Although The Model Book (TMB) has attempted to provide accurate information on the service to you, The Model Book (TMB) does not assume any responsibility for, or make any representation with respect to the accuracy or completeness of such information.
3. The service or site is provided "AS IS," and The Model Book (TMB) expressly disclaims any implied or expressed warranties or conditions of any kind.
4. You specifically acknowledge that The Model Book (TMB) is not and will not be liable for any defamatory, offensive or illegal conduct by you or other third party as it relates to the site and the service.
5. The Model Book (TMB) and its associated companies and entities, suppliers and agents shall not be liable for any infection by any virus or damage to any computer that results from the use, access to the service or the site or downloads of any intellectual property there from.

The Model Book (TMB) shall not be liable or responsible for any loss or damage caused in whole or in part by the occurrence of any contingency beyond the control of The Model Book (TMB), including but not limited to fires, civil unrest, riots, rebellions, accidents, explosions, interruptions or imperfections in telephone cables or computer systems, network or internet disruptions, electrical disturbances, power failures, satellite malfunctions or interruptions, floods, storms or any similar act or act of god.
7. The Model Book (TMB) shall not be liable or responsible for any loss or damage caused in whole or in part for ant action taken as a response to or as a result of any information available on the service and the sites. You hereby waive any and all claims against The Model Book (TMB) and its subsidiaries, divisions, affiliates, agents, representatives and licensors arising out of your use of the service and the sites and the information available thereon.
8. In no event shall The Model Book (TMB) its associated companies and entities, suppliers or agents be liable for any damages whatsoever, including (without limitation) special, indirect, consequential or accidental damages, including, without limitation, damages resulting from the use or reliance on the information presented, loss of profits or revenues or cost of replacement of goods.
9. Compliance with data protection laws applying in any jurisdiction where the service is used by you or otherwise applying to you shall be your sole responsibility and you hereby warrant to The Model Book (TMB) that you have and will comply with all such data protection laws in connection with your use of the Service.
10. You will provide The Model Book (TMB) with all information reasonably requested by it within 30 days of a request by The Model Book (TMB) requesting such.
11. The subscription shall be governed by this agreement which shall apply irrespective of whether you have provided in any order or otherwise for any other terms and conditions to apply to this License, such other terms and conditions being of no effect.
If any part of this agreement is determined by any competent authority to be invalid, unlawful or unenforceable to any extent, it shall to that extent be severed from the remainder of the agreement, which shall continue to be valid and enforceable.
You agree to defend, indemnify and hold harmless The Model Book (TMB), its associated companies and entities, its suppliers and their respective officers, and agents and/or any other third party associated with or in the employ of The Model Book (TMB) or such other Person from and against all claims and expenses, including legal fees, arising out of your use of the service and the site or any use made of your account with The Model Book (TMB).
The Model Book (TMB) shall have the right at any time, without notice, to change, suspend, discontinue, withhold or refuse access to any aspect or feature of the service or the site, including, but not limited to, content, hours of availability and equipment and software needed for access or use. The Model Book (TMB) may also impose limits on certain features and services or restrict your access to parts or the entire service or site without notice or liability on its part. The Model Book (TMB) reserves the right at any time to withdraw the service or any part thereof or terminate this agreement if The Model Book (TMB) ceases, for whatever reason, or no longer retains the right to license the service or any part thereof, or if, in The Model Book (TMB)'s sole discretion and on reasonable grounds believes that the service or any part thereof contains any material which infringes copyright or is defamatory, obscene, unlawful, or otherwise objectionable. The Model Book (TMB) could permanently remove the offending users profile without warning or refund.
The Model Book (TMB) may wish to identify you in its marketing materials as a subscriber or licensee of the service. Your use of the service indicates our permission for The Model Book (TMB) to use your personal data in this manner unless you notify The Model Book (TMB) otherwise, in writing.
Model Book (TMB) shall have the right at any time to change or modify the terms of this agreement and the terms and conditions applicable to your use of the service, or any part thereof, or to impose new conditions, including, but not limited to, changing fees and charges for use. such changes, modifications, additions or deletions shall be effective immediately upon The Model Book (TMB) discretion. Your continued use of the service or the site after such notice shall be deemed to constitute acceptance of such changes, modifications or additions.
You acknowledge and agree that any communications made to or by means of any portion of the Site are public. You acknowledge that: (i) you have no expectation of privacy in any communication\; and (ii) no confidential, fiduciary, contractually implied or other relationship is created between you and The Model Book (TMB) by reason of your transmitting a communication to any area of the site or through the service.

Users of The Model Book (TMB) will receive regular email updates and will be contacted by other system members seeking to work with you. Users will receive occasional email from The Model Book (TMB). As new promotions are developed and launched.
The Model Book (TMB) and its affiliates do not review or monitor any web sites linked to the Service or from personal portfolios on this site.
When clicking links to other users personal pages, profiles or posts from The Model Book (TMB) all users acknowledge that The Model Book (TMB) is not responsible for the accuracy or content of those links.
Links to or any inappropriate reference to (as determined by The Model Book (TMB)) adult Sites or Pay sites are strictly forbidden on The Model Book (TMB) website. Users agree not to post any such links.
The Model Book (TMB) does not support the promotion of goods services or other organizations that are not appropriate to the original purpose of The Model Book (TMB) of user self-promotion. The Model Book (TMB) reserve the right to remove any posts that at is sole discretion are deemed to be in contrast or violation to the above without notice. Referrals made by users in contrast to the above term could cause the immediate cancellation and removal of said user without notice or refund.
Links to or any inappropriate reference to sites i.e. adult sites and or pay to view sites that are deemed to be unsuitable by The Model Book (TMB) are strictly Forbidden on The Model Book (TMB) website. Users agree not to post any such links or references. The Model Book (TMB) reserves the right to remove any such links, references, media or code, will be removed without notice. In extreme cases profiles will be removed without notice or refund.
The Model Book (TMB) does not in any way shape or form support the promotion and or recruitment of escorts, escort services, personal companions, etc. Any such promotion is in the most direct violation of The Model Book (TMB) user terms and conditions. Any such posts links, references, media or code, will be removed without notice. In extreme cases profiles will be removed without notice or refund.
The Model Book (TMB) does not in any way shape or form support the soliciting of escorts, escort services, personal companions, etc. Any such action posts or references are in the most direct violation of The Model Book (TMB) user terms and conditions. The Model Book (TMB) does not in any way shape or form support the posting of sexually explicit images to the website or any other part of the service. Sexually explicit images are not permitted. Sexually explicit images include but are not limited to images of sexual intercourse, obvious states of sexual arousal (erections), or overt sexual positions (such as noticeably visible or spread genitalia). Any such posts links, references, media or code, will be removed without notice. In extreme cases profiles will be removed without notice or refund
Users understand that despite The Model Book (TMB)s non sexually explicit content policy, The Model Book (TMB) may contain un-edited materials some of which are sexually explicit and or may be offensive. User accesses such materials at his or her own risk. The Model Book (TMB) has no control over and accepts no responsibility whatsoever for such materials.
The Model Book (TMB) does not support the linking of images from The Model Book (TMB) to other sites, or the misuse of links from other sites to The Model Book (TMB). Users found linking images from The Model Book (TMB) to other sites, copying content from The Model Book (TMB), or inappropriately linking to The Model Book (TMB) (to increase their hits- through use of hidden framesets. Any such links, or code, will be removed without notice. In extreme cases profiles will be removed without notice or refund
The Model Book (TMB) is not intended for users under the age of 16. Users under the age of 16 may not under any circumstances\; apply join manage edit or post any information or images on The Model Book (TMB).

Legal guardians of a user of 16 years or younger, may manage a users profile on their behalf, all contact information given must be the direct contact of the Legal guardian and not the user.

The Model Book provides portfolio-hosting services for its members. The contents of portfolios are the sole responsibility of the member. Any images being used without the permission of the copyright holder will be removed. Unsuitable material will be removed at the discretion of the TMB team and could result in the permanent removal of a member from the site. Please report any misuse of the TMB site to the TMB team.
